Terms and Conditions

Introduction

Please take the time to read and accept our updated terms and conditions to ensure a smooth and enjoyable experience for you and your child with Happy Swimmers. These terms include important information regarding payment and class details.

References

References to "us/we/our" pertain to the Happy Swimmers.

Acceptance of Terms

You must accept our Terms and Conditions online when you first register. Attending the lesson implies your acceptance.

Double Nappy System

All babies/toddlers not potty trained/partially potty trained must adhere to our double nappy system. Underneath is a swim nappy and on top is a happy nappy. This rule to be reinforced strictly during classes. In the event that a fecal accident occurs, the cost for cleaning any leakages in the pool will be required from the responsible adult, to be directly dealt with the pool owner.

Booking

Our courses run year-round according to our published swimming dates. When you first sign up with Happy Swimmers, the details of your course, including day and time, will be agreed upon in advance. You'll swim on the same day and time at the same venue throughout your subscription. A confirmation email with booking details will be sent to you.

It might take up two months of weekly sessions for your child to build confidence in the water, so we require at least 8 scheduled lessons for our subscriptions. Your subscription will automatically renew each month until you decide to cancel, as detailed in the Refunds and Cancellation section below.

Monthly subscription payments are calculated based on the cost of the lessons scheduled for the upcoming month.

Payments

Your first payment is due at the time of booking and is secured via direct debit. You will receive email confirmation of this initial booking. If another method of payment is preferred, please get in touch so we can arrange.

Subsequent monthly payments are due on the first working day of each month (payment by direct debit). Card details are securely stored by a third party for continuous payment authority, allowing us to debit the card as needed. If you do not wish to grant this authority, please notify us in writing via email.

For Direct Debit payments, you are protected by the Direct Debit Guarantee, processed by a third-party company. Details of our supplier and their terms will be provided upon successful setup of your Direct Debit mandate.

Failure to receive payments as outlined may result in losing your place in the course.

Outstanding payments must be settled before attending lessons again, and missed lessons due to non-payment are not refundable or eligible for catch-up.

Changing Class Times and Venues

If you need to change your swim time, please contact us with as much notice as possible. We will do our best to accommodate but cannot guarantee changes. Any cost changes due to rescheduling will be communicated.

We may also contact you about changes in class time or venue. As class sizes fluctuate, we might need to merge smaller classes. We will give at least one month’s notice of any such changes. If you are unhappy with the new arrangements, you may cancel your subscription as per the Refunds and Cancellation section.

Refunds and Cancellations

New Clients

New clients can cancel their contract within 7 days of receiving the Terms and Conditions or up to 14 days before the first course starts for a full refund.

Current Clients

After the initial cancellation period or after attending your first scheduled lesson, you are considered a current client. To cancel, inform us in writing by email. Your subscription will end on the last scheduled lesson in the following month. We will acknowledge your cancellation notice. If not acknowledged, please contact us again.

If cancellation occurs within three working days of the billing date, the full month's subscription payment will still be required. Do not cancel your Direct Debit or payment authority; we will handle the cancellation and confirm via email. A further payment may be due for lessons remaining in your notice period.

In case of short-term pool unavailability, we will reschedule your lesson if possible. No refunds for travel expenses will be provided. If lessons are cancelled and cannot be rescheduled, we will credit your account balance.

If the pool is unavailable for more than a week due to reasons beyond our control, and rescheduling is not possible, we will refund the unused balance of your subscription or offer services or refunds for future bookings.

No refunds or transfers are provided for missed lessons, including during the notice period.

Catch-Up Lessons

You may request a maximum of three catch-up lessons for each 6-month block (September-February and March-August) if you miss a lesson. Catch-up lessons expire at the end of each 6-month block. We are not responsible for travel expenses. If you need to cancel a catch-up lesson, notify us to avoid losing the opportunity. Catch-up lessons are a goodwill gesture and have no cash value.

Adverse Weather

We do not refund lessons missed due to local adverse weather if the venue is safe and lessons proceed. Refunds or rescheduling are not automatic in such cases.

Video and Photography

We encourage a family atmosphere but ask that you respect the privacy of others. If someone requests no photography, please comply.

Occasionally, we may take photos for class sharing, newsletters, or social media with your consent. These will not be used for other purposes without your explicit permission. Any reproduction of our lessons is prohibited without written agreement.

Valuables and Jewelry

All personal property is left at your own risk. Happy Swimmers is not responsible for lost or damaged belongings. Please remove all jewelry before entering the water.

Illness

Consult your doctor before swimming if you or your child has any medical conditions. Inform us in writing if your illness is contagious. Do not attend classes if you have symptoms of illness. Ensure symptoms have cleared for 72 hours (diarrhoea, vomiting) before returning. Teacher may refuse pool entry if they believe your child is unwell.

Nappies and Changing

All babies/toddlers must wear a double nappy system: a reusable cotton nappy or disposable swim nappy with a Happy Nappy® on top. Non-compliance will result in denied entry.

Always change your baby on the floor using a suitable mat. Do not use raised surfaces. Take used nappies with you unless a marked bin is provided.

Withdrawal of Service

Happy Swimmers may refuse entry if client behavior or associated behavior is unreasonable or poses a health and safety issue.

Pool/Poolside Health and Safety

No footwear or prams are allowed poolside or in changing rooms. Please use overshoes or go barefoot.

Keep noise to a minimum poolside to ensure a calm atmosphere. Supervise children at all times. Adhere to pool rules. Only one adult per child in the pool at a time, but others can bring the child to classes.
